Terms of Service

T&H Nobles LLC — thnobles.com and portal.thnobles.com

These Terms of Service ("Terms") are a contract between you and T&H Nobles LLC ("T&H Nobles," "we," "us," or "our"). They cover your use of our websites, thnobles.com and portal.thnobles.com (together, the "Sites"), and our future iOS and Android mobile app (the "App"). Together the Sites and the App are called the "Services."

1. Acceptance

By using the Services — browsing, creating an account, or making a purchase — you agree to these Terms. If you do not agree, do not use the Services.

You must be 18 or older to make a purchase. Portal accounts are open to users 13 and older; if you are under 18, you may use a portal account only with a parent or guardian's permission (see Section 3).

If we change these Terms, we will post the updated version with a new "Last updated" date. Your continued use of the Services after changes are posted means you accept the new Terms.

2. License to use the app

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your own personal, non-commercial use. You may not:

• Copy, modify, distribute, or create derivative works from the Services;
• Reverse-engineer, decompile, or attempt to extract the source code of the App or portal;
• Sell, rent, lease, or sublicense your access to the Services;
• Remove any copyright, trademark, or other proprietary notices.

3. Eligibility

• You must be 18 or older to make a purchase on the Services.
• You must be 13 or older to create a portal account. If you are under 18, you represent that you have your parent or guardian's permission.
• One account per person. You must provide accurate registration information and keep it updated. You are responsible for activity under your account.

4. Subscriptions, pricing, and billing

• No subscriptions. We do not currently offer subscriptions; all purchases are one-time.
• All prices are in U.S. dollars (USD). We may change prices at any time, but price changes do not affect orders already placed and confirmed.
• Pricing errors. If a product is listed at an incorrect price due to an error, we may cancel the affected order and issue a full refund.
• Store-credit top-ups. Store credit can be topped up in $10, $25, $50, or $100 amounts. Top-ups are prepaid and non-refundable, have no cash value, are non-transferable, and never expire.
• Rewards credit. Our rewards program gives 3% cashback on every order, $1 in store credit per order, and 3% of a friend's first order through referral links. Rewards credit has no cash value, cannot be redeemed for cash, expires 30 days after it is earned, and may be forfeited for fraud or abuse (see Section 8).

5. Your content and recordings

You may submit reviews, photos, questions, feedback, and messages to our AI chat helper ("Your Content"). By submitting Your Content, you grant us a worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute it in connection with the Services, represent that you own it or have the rights to share it, and agree we may remove it at our discretion.

AI chat logs. Conversations with our AI chat helper may be logged and used to improve the Services. Do not send sensitive personal information through the chat.

6. Recording other people

If you upload photos or videos that show other people, you confirm that you have those people's consent to share the image with us. We will act on valid takedown requests for imagery posted without consent; contact us at info@thnobles.com.

7. Third-party services

The Services rely on third parties, including:

• Shopify (store hosting and checkout);
• Supabase (portal backend);
• Zendrop and other suppliers (product fulfillment and shipping);
• Payment processors and shipping carriers.

We are not responsible for third-party outages, delays, errors, or actions. Their own terms and privacy policies apply.

8. Acceptable use

You agree not to:

• Use the Services for any unlawful purpose;
• Scrape the Services or use bots or automated tools;
• Commit fraud, including payment fraud, false refund claims, or chargeback abuse;
• Create multiple accounts to game rewards, referrals, or promotions. Referral fraud will result in forfeiture of rewards credit and may result in account termination;
• Resell our products commercially without our written permission.

Violations may result in order cancellation, account suspension or termination, and forfeiture of rewards credit.

9. Our intellectual property

The T&H Nobles name, emblem, black-and-gold branding, and all text, images, designs, and content on the Services are owned by us or our licensors and are protected by intellectual property laws.

DMCA. If you believe content on the Services infringes your copyright, send a takedown notice to info@thnobles.com.

10. Disclaimers

THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

• Wellness & recovery products. These products are not medical advice and have not been evaluated by the FDA. Consult a doctor before use. Results vary by individual.
• Pet products. Always supervise your pets when using our products. They are not a substitute for veterinary care.
• AI chat helper. Our AI chat helper is an automated tool. Its answers may be inaccurate and are not professional advice. Verify important information independently.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, T&H NOBLES LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THEM.

OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR ORDER AT ISSUE — OR $100 IF THE CLAIM DOES NOT RELATE TO A PURCHASE.

12. Indemnification

You agree to indemnify, defend, and hold harmless T&H Nobles LLC, its members, officers, and employees from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Services, your content, or your violation of these Terms or any law.

13. Termination

• By us. We may suspend or terminate your account, or cancel orders, if you violate these Terms, commit fraud, or abuse the chargeback process. Rewards credit and store credit are forfeited when an account is terminated for cause.
• By you. You may delete your portal account at any time by contacting us at info@thnobles.com.

14. App Store terms

These terms apply if and when we release our iOS and Android app. The Apple App Store and Google Play are not parties to these Terms. Any in-app purchases are processed through Apple or Google's systems and are subject to their terms.

15. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles.

16. Dispute resolution and arbitration

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES BINDING ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS.

• Informal resolution first. Before filing any claim, email info@thnobles.com describing the issue; we will attempt to resolve it within 30 days.
• Binding individual arbitration. If we cannot resolve the dispute informally, either party may require binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
• Class-action and jury-trial waiver. Disputes will be resolved only on an individual basis — not as a class, collective, or representative action — and you waive any right to a jury trial.
• Small-claims exception. Either party may bring an individual claim in small-claims court instead of arbitration, as long as the claim qualifies.
• Opt-out. You may opt out of arbitration by emailing info@thnobles.com within 30 days after your first use of the Services.

17. State-specific notices

• California. Some products may contain chemicals known to the State of California to cause cancer or reproductive harm. California residents have rights under California consumer-protection laws.
• New Jersey. Under New Jersey's Truth-in-Consumer Contract, Warranty and Notice Act, certain provisions of consumer contracts may be unenforceable in New Jersey; nothing in these Terms limits your rights under New Jersey law.
• Privacy. Your state may grant you privacy rights. See our Privacy Policy for details.

18. Changes and contact

We may update these Terms from time to time. For material changes, we will notify you by email or by a banner on the Sites. Your continued use of the Services after changes take effect means you accept the updated Terms.
